YOUR USE OF THE WEBSITE OR ANY TRAINERLIST PRODUCTS AND SERVICES will generally be understood as your consent to the collection, use and disclosure of your Personal Information as described in this Privacy Statement which is subject to change as described below. If you do not consent, you must not access or use the Website, or any of the TrainerList Products and Services. TrainerList Inc. (“TrainerList”, “we” or “us”) is committed to maintaining trust with the users of our Website. TrainerList uses the Website to provide you with information about our programs, products and services. Any information, training information, customer service or any related services provided to you through the Website are referred to in this Privacy Statement as the “TrainerList Products and Services”. We are committed to the protection of your privacy. To help us meet this commitment to you, we have created this Privacy Statement, as may be amended from time to time. For the purposes of this Privacy Statement, the term “Website” means https://trainerlist.com/ (including without limitation any mobile optimized website). This Privacy Statement does not apply to your use of, or the collection, use or disclosure of personal information by, any third party websites or mobile applications even if such third party websites or mobile applications are linked to from the Website. This Privacy Statement describes how TrainerList collects, protects, uses and discloses Personal Information (as defined below) that is collected by TrainerList. To take advantage of some of the features of the Website you may have to provide us with your Personal Information.
PERSONAL INFORMATION For the purpose of this Privacy Statement, “Personal Information” means information about an identifiable individual. “Personal Information” may include, but is not limited to, a person’s name, email address, residential address, telephone number, payment card information, transaction history, credit history and credit information from credit reporting agencies, and other billing information, as may be applicable.
APPLICATION OF THIS PRIVACY STATEMENT This Privacy Statement applies to Personal Information collected by, or supplied to, TrainerList through the Website and the TrainerList Products and Services. The Website contain links to third party websites and mobile applications (the “Linked Sites”) that are not controlled or operated by TrainerList. The Linked Sites are maintained by the third parties who have their own privacy policies and their own terms and conditions of use. This Privacy Statement does not apply to any of the Linked Sites and TrainerList is not responsible for any Personal Information disclosed by virtue of those Linked Sites or for the privacy practices of any operators or sponsors of the Linked Sites. To determine how Personal Information will be treated when accessing or using the Linked Sites, you must read the privacy policy, if any, that applies to each of the Linked Sites. We may partner with third party vendors to facilitate their provision of products and services to you. This Privacy Statement only applies to the Personal Information that TrainerList collects and uses, or discloses through the operation of the Website and the TrainerList Products and Services. Any Personal Information that you provide to third party vendors or that we disclose to third party vendors at your direction is dealt with in accordance with the privacy policies adopted by each of those vendors. All amended terms shall be effective immediately upon being posted even in some cases without express or specific notice to you of those changes. Your continued access or use of the Website or any of the TrainerList Products and Services after such modification of the Privacy Statement will constitute your acceptance of the modified Privacy Statement. The most current version of this Privacy Statement will govern your use of the Website. You are encouraged to review this Privacy Statement from time to time to ensure your continued agreement. We will notify you in advance of any material changes to this Privacy Statement.
WHAT PERSONAL INFORMATION WE COLLECT The Personal Information that we collect depends on how you use and interact with the Website and the TrainerList Products and Services, but may include: • Contact information: such as your name, address, phone number, email address and preferred language. • Cookies and Website usage information: information on how you use the TrainerList Products and Services, personal preferences, the devices you connect from and their settings, country code, IP address-associated location, date and time of your use, and other information captured through essential and non-essential cookies, as described in more detail below. • Account information: such as your username, password, and any other account-related information that you provide when creating an account on the Website. • Credit and financial information: such as your credit card, pay pal or other banking information. • Demographic information: such as age, gender and any other demographic information you may choose to provide to us when creating an account or using TrainerList Products and Services. • Trainer Qualifications and Services: such as trainer CV, proficiencies and training types, licenses and/or certifications, rates, and any biographical and other information entered on your profile, such as links to your personal and/or professional social media accounts and details provided in the “Describe Yourself” section. • Recording Information: such as photographs or videos of you. • Communication information: information that you provide when you contact us for any reason, communicate with other users through our Website, provide reviews, or use the "Contact Us" form on the Website.
HOW WE COLLECT INFORMATION Your Personal Information is collected in connection with your access to and use of the Website, for example when you browse the Website, create an account, submit a request or question through our Website, or email a request for information from us. Generally, we collect Personal Information directly from you, but we may also collect it from third parties where you consent or where we are permitted by law to do so.
(a) Information collected automatically When you visit the Website, some information (for example, the site from which you linked, your Internet Service Provider, the time and date of your visit, your device ID) may be collected automatically by the software that operates our Website. HOW WE USE YOUR PERSONAL INFORMATION We use Personal Information for the following purposes: • to provide the TrainerList Products and Services; • to process applications for trainee and/or trainer; • to empower registered trainers to showcase their profiles and promote their skills; • to connect registered trainees with registered trainers, enable communication between trainees and trainers, and otherwise facilitate the provision of training services to trainees; • to process online purchases; • to send communications to users have opted-in to receive, and to process “unsubscribe” requests; • to respond to users’ questions and comments; • to personalize and tailor users’ experience of the Website; • to improve and troubleshoot problems with the Website and the TrainerList Products and Services; • to help TrainerList analyze the browsing and usage patterns of its users in order to improve the content and design of its Websites; • for security purposes, such as the prevention of fraud and potentially prohibited or illegal activities; • to enforce the Terms of Use of the Website; • for statistical analysis; • to meet any legal or regulatory requirements; • to conduct marketing, including promotional activities; • as otherwise described to you when the information is collected; and • for any other purposes, or to take any other action, required or permitted by law.
HOW WE SHARE PERSONAL INFORMATION We may transfer Personal Information to our service providers (including affiliates acting in this capacity) who perform services on our behalf, such as data hosting and processing, analytics, marketing, information technology and information security, and similar services, and who are contractually obligated to keep Personal Information confidential, use it only for the purposes for which we transfer it to them, and to process the Personal Information with the same standards set out in this Privacy Statement. We disclose certain personal information provided by our registered trainers to the registered users of our Website to enable those users to select and use training services. In particular, we share trainers’ names, qualifications, proficiencies, rates, contact information, and biographical and other information entered on trainers’ profiles, including links to social media accounts. We may disclose Personal Information to our business partners who have agreed to comply with legally required privacy standards and who will use the information only for the purposes disclosed at the time of collection, or for a use consistent with that purpose. We may disclose Personal Information if we reasonably believe that we are permitted or required to do so by law or legal process, or if we are otherwise requested by any law enforcement officer or agency acting under colour of law. We may disclose Personal Information in order to (i) enforce the Terms of Use of the Website, (ii) protect and defend the rights of TrainerList; or (iii) act in urgent circumstances to protect the safety or security of the public or users of the TrainerList Products and Services or the Website. We may also disclose your Personal Information in accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our customers and users is among the assets transferred.
STORAGE AND SECURITY TrainerList has implemented reasonable physical and technical measures to protect Personal Information obtained through the Website against loss or theft, unauthorized access, use or disclosure. We may also transfer your Personal Information outside of the province in which you reside, including within and outside Canada.
ACCURACY You can help TrainerList maintain the accuracy of your Personal Information by notifying TrainerList of any changes to such information. You are responsible for ensuring that all information created through your use of the Website and the TrainerList Products and Services is accurate, reliable and complete.
MINORS The Website is intended for general audiences but is not to be used by individuals under 18 years old (“minors”). We do not knowingly collect Personal Information from minors. If you become aware that your child has provided us with Personal Information without your consent, please contact us at the email address below. If we become aware that a minor has provided us with Personal Information without parental consent, unless we are legally obligated to retain such data, we take steps to remove such information from our files.
